Anthony's Coal Fired Pizza is a food service business specializing in coal-fired pizza and related food and beverage offerings. Through the Site anthonyspizzas.top, we provide the following services:

2.1 Online Ordering

Users may browse our menu and place orders for pickup or delivery (where available). The Site allows Customers to customize their orders, select delivery or pickup options, and process payment for food and beverage items offered by Anthony's Coal Fired Pizza.

  • Unauthorized Access: Attempting to gain unauthorized access to the Site, our servers, databases, or any connected systems through hacking, password mining, or any other means.
  • Interference: Interfering with or disrupting the integrity or performance of the Site, including transmitting viruses, worms, malware, or any other harmful or destructive code.
  • Scraping or Data Mining: Using automated tools, bots, spiders, scrapers, or similar means to access, collect, or extract data from the Site without our express written consent.

5. Ordering, Payment, and Pricing

All orders placed through the Site are subject to acceptance by Anthony's Coal Fired Pizza. We reserve the right to refuse or cancel any order at any time for any reason, including but not limited to: product unavailability, errors in pricing or product information, suspected fraudulent activity, or limitations on quantities available for purchase.

Once an order is placed, you will receive a confirmation notification via email or through the Site. This confirmation does not constitute our acceptance of the order; acceptance occurs when we begin preparing your order.

5.2 Pricing

All prices displayed on the Site are in United States Dollars (USD) and are subject to change without notice. Prices do not include applicable taxes, delivery fees, or service charges unless explicitly stated. We strive to ensure that all pricing information on the Site is accurate; however, errors may occasionally occur. In the event of a pricing error, we reserve the right to cancel the affected order and notify you accordingly.

5.3 Payment

Due to the perishable nature of food products, all sales are generally final once an order has been confirmed and preparation has begun. 6. Intellectual Property Rights

The name "Anthony's Coal Fired Pizza," the Company's logo, and all related names, logos, product and service names, designs, and slogans are trademarks or service marks of Anthony's Coal Fired Pizza or its licensors. All other names, logos, product and service names, designs, and slogans on the Site are the trademarks of their respective owners.

6.2 License to Use the Site

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site solely for your personal, non-commercial purposes in connection with ordering food and beverage products from Anthony's Coal Fired Pizza. This license does not include:

7. Disclaimers and "As-Is" Basis

Anthony's Coal Fired Pizza expressly disclaims all warranties, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • Warranties that the Site will be uninterrupted, error-free, secure, or free from viruses or other harmful components.
  • Warranties regarding the accuracy, completeness, timeliness, or reliability of any content, information, or materials on the Site.
  • Warranties regarding the quality, safety, or suitability of any food or beverage products offered through the Site for individuals with specific dietary restrictions, allergies, or medical conditions.

8. Limitation of Liability

In no event shall our aggregate liability to you for all claims arising from or related to the use of the Site or any products or services exceed the greater of: (a) the total amount you paid to us in connection with the specific order giving rise to the claim, or (b) One Hundred United States Dollars ($100.00).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you. In such jurisdictions, our liability shall be limited to the maximum extent permitted by applicable law.

9. Indemnification

You agree to defend, indemnify, and hold harmless Anthony's Coal Fired Pizza, its affiliates, licensors, service providers, employees, agents, officers, directors, and shareholders from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your User Content or any content you submit, post, or transmit through the Site.
  • Your violation of any third party's rights, including intellectual property rights, privacy rights, or proprietary rights.

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.

12. Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the United States of America and the state in which Anthony's Coal Fired Pizza is registered and operates, without regard to its conflict of law provisions.

Any legal suit, action, or proceeding arising out of or related to these Terms or the Site shall be instituted exclusively in the federal or state courts of competent jurisdiction in the United States. You waive any objection to the exercise of jurisdiction over you by such courts and to venue in such courts.

The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.

13. Dispute Resolution

13.1 Informal Resolution

Before initiating any formal dispute resolution process, you agree to first contact Anthony's Coal Fired Pizza at [email protected] and provide a written description of the dispute, the relief you are seeking, and your contact information. We will attempt to resolve the dispute informally within thirty (30) days of receipt of your notice. If the dispute is not resolved within this period, either party may proceed to the formal dispute resolution methods described below.

13.2 Binding Arbitration

EXCEPT FOR CLAIMS THAT QUALIFY FOR SMALL CLAIMS COURT, ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE, OR THE SERVICES THAT CANNOT BE RESOLVED INFORMALLY SHALL BE RESOLVED BY BINDING ARBITRATION ON AN INDIVIDUAL BASIS, RATHER THAN IN COURT.

The arbitration shall be conducted by a recognized arbitration institution in accordance with its rules and procedures. The arbitration shall take place in the United States, and the arbitrator's decision shall be final and binding. Judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.

13.3 Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If for any reason a claim proceeds in court rather than in arbitration, you and Anthony's Coal Fired Pizza each waive any right to a jury trial and each waive any right to participate in a class action lawsuit or class-wide arbitration.

13.4 Small Claims Court

Notwithstanding the foregoing, either party may bring an individual action in small claims court if the claim qualifies under applicable small claims court rules and the amount in dispute falls within the small claims court jurisdictional limit.

13.5 Consumer Rights

Nothing in these dispute resolution provisions shall limit any rights you may have under applicable consumer protection laws, including rights under the FTC Act or applicable state consumer protection statutes that cannot be waived by contract.

14. Term and Termination

14.1 Term

These Terms shall remain in full force and effect while you use the Site or maintain any account with us. Certain provisions of these Terms, by their nature, shall survive the termination of these Terms, including but not limited to provisions relating to intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution.

14.2 Termination by You

You may terminate your account and cease use of the Site at any time by contacting us at [email protected] or by following the account deletion procedures available within your account settings (if applicable).

14.3 Termination by Us

We reserve the right, at our sole discretion, to suspend or terminate your account and access to the Site at any time, with or without cause and with or without notice, including if we reasonably believe:

  • Your use of the Site poses a risk to us, our customers, or third parties.
  • You have engaged in fraudulent, abusive, or disruptive behavior.

18. Severability

If any provision of these Terms is found by a court of competent jurisdiction or arbitrator to be invalid, illegal, unenforceable, or in conflict with any applicable law, such provision shall be modified to the minimum extent necessary to make it enforceable, or, if modification is not possible, such provision shall be severed from these Terms. The remaining provisions of these Terms shall continue in full force and effect and shall not be affected by the invalidity or unenforceability of any other provision.

The invalidity or unenforceability of any provision in any jurisdiction shall not affect the validity or enforceability of that provision in any other jurisdiction, nor the validity or enforceability of any other provision of these Terms in any jurisdiction.

19. Waiver

No failure or delay by Anthony's Coal Fired Pizza in exercising any right, power, or remedy under these Terms shall operate as a waiver of that right, power, or remedy. No single or partial exercise of any right, power, or remedy shall preclude any other or further exercise of that right, power, or remedy or the exercise of any other right, power, or remedy. Any waiver of any provision of these Terms shall be effective only if in writing and signed by an authorized representative of Anthony's Coal Fired Pizza.

20. Entire Agreement

These Terms of Service, together with our Privacy Policy and any other legal notices, policies, or guidelines published by us on the Site, constitute the entire agreement between you and Anthony's Coal Fired Pizza with respect to your use of the Site and the services offered therein. These Terms supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to the Site and our services.

No other prior or contemporaneous oral or written statement by any employee, agent, or representative of Anthony's Coal Fired Pizza shall be incorporated into or form any part of this agreement.
